Terms of Service for the Claims Calculator Claim Score Guarantee

The Claims Calculator Claim Score Guarantee ("Guarantee") is sponsored and managed by Griffin Data Services, LLC ("Griffin Data"). For Claim Score's with a Guarantee, it means that your Claim Score has been accurately calculated using our proprietary software and algorithms based on the inputs and information you provided. It is not a guarantee that your claim will be adjusted or that the estimates set forth in the Claim Score will be the cost to repair the property.

This Guarantee does not apply to users of the free version of Claims Calculator (the "Product"). This Guarantee only applies to paid users. Moreover, this Guarantee only applies to residential homeowner property insurance claims and is for the lifetime of your claim, which is defined as the applicable statute of limitations from the Date of Loss as set forth by the applicable law which governs the location where the loss occurred.

Guarantee

We work to ensure the accuracy of the calculation on every report prepared by the Product (the "Claim Score"). The Guarantee applies only to homeowner property insurance claims analyzed using the Product, only if the subject property suffered a covered loss as determined by the property insurer, and all subject to the terms and conditions below:

1. Claim Score Guarantee Terms

If you are a registered user and Claims Calculator makes a calculation error in the Claim Score that was not the result of, among other things:

• your failure to enter all required information accurately
• willful or fraudulent omission or inclusion of information in your claim
• misclassification of information in your claim
• insurance policy changes made by federal or state governments after your claim was filed
• insurance law changes made by federal or state governments after your claim was filed

then you, at your option, may initiate a Claim Score Guarantee Claim ("Guarantee Claim") with us, pursuant to the procedures set forth in subsections below. After receipt and review of the Guarantee Claim, we may, in our sole and absolute discretion, either (i) reimburse you the amount actually paid by you to Griffin Data, but not any amounts for penalties or interest due, nor payable or paid by you as a result of a payment you made; or (ii) re-evaluate and re-analyze your claim and provide you another Claim Score.

2. How to Initiate a Guarantee Claim

To initiate a claim under this Guarantee, please contact Griffin Data using the instructions set forth on our website. You will be required to provide all claim-related documents within 14-days of request, and any other relevant documents or information we reasonably request, either electronically or by First-Class U.S. mail with USPS Tracking (to ensure tracked delivery), to enable Griffin Data to validate and process your claim.

To validate and re-evaluate a claim under a Guarantee Claim, Griffin Data may require, among other information, your Claims Calculator data file, a copy of your insurance policy, the carrier claim, and any other documents and/or claim communications to support your claim. You are responsible for maintaining all information and documents that may be relevant to the accuracy of your Claim Score.

In this regard, you are responsible for keeping Griffin Data apprised promptly of any change in the status of your claim, your email address, mailing address and/or phone number so that you can be notified of such updates or corrections. After Griffin Data receives all necessary and relevant claim-related information and documentation requested from you under the Guarantee Claim, in Griffin Data's discretion, Griffin Data will re-evaluate and re-analyze your claim using the Product and provide you another Claim Score at no additional cost.

This guarantee does not apply to commercial claims or any claims that do not satisfy the requirements set forth in this Guarantee.

3. Claims Calculator Satisfaction Guaranteed

Our satisfaction guarantee posits that if we are unable to "prove" a satisfactory performance of the Product with a test file, we will refund the amount actually paid by you to Griffin Data, but not any amounts for penalties or interest due, nor payable or paid by you as a result of a payment you made.

Some versions of the Product allow you to use the Product to generate a Claim Score without charge up to the point you decide to print or electronically download, or otherwise use, in part or whole, your Claim Score. You understand and agree that printing, electronically downloading or otherwise using, in part or whole, your Claim Score reflects (a) your satisfaction with Product and Claim Score and (b) your acknowledgement and understanding that you are, at the time of printing or downloading, voluntarily paying for the Services, and you therefore waive the right to receive a refund.

No Guarantee of Product Availability

Because of the nature of the internet and online communications, the website or the Product may not perform as intended despite our efforts, those of your internet service provider, and you. We do not guarantee uninterrupted or error free operation of the Product or the website. From time-to-time, technical issues may also result in the unavailability of or disruption of certain Products or features.

In addition, your use of a product that is excessive or in a manner not contemplated by this Guarantee may also result in a Product not performing as intended despite our efforts. We will use reasonable efforts to maintain operation of the website and availability of the Product at all times. If there is a system error or other problem concerning the Product, you agree to promptly notify us of the same, we will try to correct the error, but you will not be entitled to any money for any system error of any type except for monies you paid for Product that we do not provide.

Certain Product features within the Product may be provided by third-parties or may be dependent on data provided by third parties. We may be unable to provide such Product features because the third party will no longer provide the features, service or data to us, or will no longer provide the Product feature or data on the terms that we believe, in our sole discretion, to be commercially reasonable.

Disclaimer

We do not warrant that the Product is error-free, secure, or free from any viruses or other harmful components. We also do not provide any warranties with respect to data loss or to the accuracy, reliability, or availability of the Product, nor of any content or information made available in the Product. If the exclusions for implied warranties do not apply to you, any implied warranties are limited to sixty (60) days from the date of purchase or use of the Product, whichever is sooner.

In no event will we be liable to any party for any damages of any kind, including but not limited to, direct, indirect, special or consequential damages for any use of the Product or Claim Score including, without limitation, loss of use, lost profits, business interruption, loss of programs or other data, whether in an action based on contract, negligence or other tortious action, even if we are expressly advised of the possibility of such damages. In no event do we warrant or guaranty the correctness, comprehensiveness, completeness, accuracy, timeliness, merchantability or fitness for any particular use or purpose of any information generated by any Product, including the Claim Score, featured on our website.
